1. Introduction

These Terms and Conditions (“Agreement”) govern your access to and use of our website and all related services, tools, and applications (collectively, the “Services” or “AI System”). By visiting or using ainudez.us.com, you agree to be bound by this Agreement. If you do not agree, please do not use the Website or Services.

We may update these Terms at any time. The latest revision date appears above. Your continued use of ainudez.us.com after any update constitutes acceptance of the revised Terms.

2. Services

1. Purpose and Use. ainudez.us.com provides AI-based photo processing tools that allow you to upload images and generate visual edits strictly for private, non-commercial use.
2. Jurisdictional Restrictions. The Services are not available where their use would violate applicable local laws. See Schedule 1 for restricted countries and regions.
3. User Responsibility. You are solely responsible for ensuring that your use of the Services complies with all applicable laws and regulations and for all content you upload, modify, or generate.
4. Prohibited Sharing. Generated images are intended for personal use only. Downloading, sharing, publishing, selling, or distributing generated content outside the platform may result in suspension and/or legal action.
5. Access Levels. Some features may be available without registration. Creating an account may unlock paid functionality, credit packs (“VIP Coins”), and/or subscription plans (“Plans”) as described on the Website.
6. Eligibility. You must be at least 18 years old and legally capable of entering into binding agreements in your jurisdiction. You must not upload images of any person without their explicit consent. Illegal, non-consensual, or otherwise prohibited use is strictly forbidden.

3. Data Privacy and Session Processing

All user inputs and uploads (“Input Data”) are processed within your active browser session where technically feasible. ainudez.us.com does not permanently store, record, or retain photos on its servers by default. When your session ends, Input Data is automatically deleted. No Input Data is retained, shared, or used for AI model training without your explicit consent. Please refer to our Privacy Policy for further information.

4. Service Modifications

We may modify, update, suspend, or discontinue the Website or any part of the Services at any time without prior notice. Any new features or tools introduced will also be governed by these Terms.

5. Prohibited Use

You must not upload, generate, or attempt to generate content that:

• Depicts minors (under 18) or non-consensual acts;
• Infringes intellectual property, privacy, or publicity rights, or uses another person’s likeness without authorization;
• Promotes or incites violence, terrorism, harassment, exploitation, discrimination, or illegal conduct;
• Attempts to bypass, disable, or manipulate AI safeguards, filters, or access controls;
• Contains malware, spam, or engages in network abuse or security attacks.

Violations may result in content blocking, account suspension or termination, and reporting to authorities where legally required.

6. AI Fairness and Transparency

We regularly evaluate and refine our AI systems to promote fairness, inclusivity, and compliance with applicable laws. We do not intentionally design the AI to produce discriminatory or harmful outputs. If you encounter problematic results, you are encouraged to contact us.

7. Training Data Disclosure

AI models used on ainudez.us.com are trained on synthetic and/or ethically sourced datasets. We do not use personally identifiable information or user-generated content for AI training or retraining without explicit consent.

8. Content Moderation

Automated moderation systems and safety reviews may be used to detect and prevent illegal or harmful content. Uploading or attempting to generate content involving minors, public figures, celebrities, or non-consensual imagery is strictly prohibited and may lead to enforcement action.

9. Children’s Data Protection

The Services are not intended for children or for processing children’s images. AI filters may automatically block such uploads. Flagged content is rejected and not retained, except where required by law to report unlawful material.

10. Monitoring and Compliance

We reserve the right to monitor use of the Services to ensure compliance with these Terms. Enforcement measures may include warnings, removal of content, feature restrictions, temporary suspension, or permanent termination of accounts. Serious violations may be reported to law enforcement authorities.

11. Payments

Registered users may purchase VIP Coins or subscription Plans for access to premium features. Prices are displayed on the Website and may change at any time. Payments must be made using the approved payment methods available at checkout. You are responsible for providing accurate payment information and for any applicable taxes or fees.

12. Refund Policy

Refund requests may be submitted within 14 calendar days of purchase, subject to eligibility and applicable consumer protection laws. If approved, refunds will be issued to the original payment method within 14 business days. Partial refunds may apply where Services have already been used. Certain promotional or consumable digital credits may be non-refundable where clearly disclosed at purchase.

13. Promotions and Marketing

We may display advertisements, conduct promotional campaigns, or send marketing communications from ainudez.us.com. You may opt out of marketing emails at any time by using the unsubscribe link provided in the communication. Promotions may be subject to additional terms.

Access to ainudez.us.com is restricted or unavailable in the following countries and territories, as well as in regions subject to comprehensive international sanctions: Afghanistan, Belarus, China, Cuba, Iran, Iraq, North Korea, Russia, Syria, Sudan, Venezuela, Yemen, Zimbabwe.

Schedule 2 – Addendum for Australian Users

1. Australian residents must comply with applicable Australian online safety and content laws.
2. Prohibited content includes material classified as restricted under relevant Australian legislation.
3. Misuse may result in suspension, termination, and/or reporting to appropriate authorities.
4. Safety notices may appear if attempts are made to generate restricted content.
